Know your weingarten rights
You may not have known this, but you have Weingarten rights! What are they? The Legal right to have someone accompany you anytime someone in management is asking you questions about something you or another person did, when the answers to the questions may result in you or another person being disciplined or discharged. And that's not all. You have the right to refuse to participate in the meeting if management refuses to let a representative attend, you have the legal right to know what the meeting is about before it begins, and you have the legal right to consult with the representative before talking to management. In addition, the Company has agreed to let you have a representative present when the are issuing discipline, but not conducting an investigatory interview. We strongly encourage you to ask for one of the stewards (or bargaining committee members) to be your representative if management asks you to come to such a meeting. They have been trained in how to handle the meeting so you get treated fairly. Below is a summary of you legal rights.
Under the Supreme Court's Weingarten decision the following rules apply during an investigation interview:
The worker may request union representation before or during the interview
After the request, the employer has three options:
1.Grant the request and delay questioning until the union representative arrives.
2.Deny the request and the end the interview immediately.
3.Give the worker a choice of: (a) having the interview without representation;
or (b) ending the interview.
